Terms & Conditions

By booking with Sydney Picnic Moments, you agree to abide by the following terms:

 

1. Booking and Payment

  • Booking Process: To secure a booking, you must pay the full amount in advance.

  • Payment Methods: Payment can be made via bank transfer or credit/debit card. For card payments, a 3% transaction fee applies. Please enquire for a secure payment link

2. Changes and Cancellations

  • Changes: If you wish to make changes to your booking, please notify us as soon as possible. Changes are subject to availability.

  • Cancellations: We do not offer refunds; however, we can issue a credit for your booking if you wish to cancel. Credit must be used within 12 months. Please email us to arrange a reschedule or credit. Note picnics & proposals cannot be rescheduled or cancelled with less than 48 hours notice.

3. Weather Policy

  • Weather Conditions: We allow reschedules free of charge due to bad weather. Please let us know at least 48 hours in advance if you would like to reschedule. Alternatively, we are happy to accommodate by setting up at a backup weather-safe or indoor location of your choice (within a reasonable distance to the original location).

  • We reserve the right to not set up in case of extreme weather conditions or unforeseen circumstances such as natural disasters, government restrictions, pandemics. In such situations.

  • In the event that you insist on proceeding with the setup despite wet weather conditions, we reserve the right to charge a "work in wet weather" fee in addition to any damages incurred to the setup items. By opting for setup in wet weather, you agree to assume responsibility for any damages that may occur to the setup items due to exposure to moisture. This extra fee must be paid in full ahead of the scheduled setup time. Failure to do so will result in the cancellation of the setup, and we will not proceed until the fee is settled.

4. Event Timing and Lateness

  • Picnic pricing is based on 2-hour picnics for groups of less than 8 guests and 3-hour picnics for groups of 8 or more guests. If you would like to extend your picnic time, this can be arranged at $50/hour.

  • Proposal setups are usually allocated for approximately 30 minutes up to a maximum of 1 hour. If you require the setup to be in place for more than 1 hour, please let us know in advance so that we may accommodate your request , subject to availability.

  • Lateness: Please be on time as we are unable to provide extra time if you are late.

  • Photography: If you've added photography to your booking, the photographer is allocated for the first 15 minutes of the setup. If you are more than 15 minutes late, your photography session may be cancelled without a refund.

5. Permits & Permissions

  • Sydney Picnic Moments will try our best to provide advice on permits to the extent of our knowledge and experience; however, the ultimate responsibility lies with the customer, for ensuring that the chosen location allows picnic & proposal setup and that all necessary permits or permissions have been obtained prior to the event. This includes, but is not limited to, permissions from local authorities or property owners.

  • Liability for Fines or Penalties: Sydney Picnic Moments is not liable for any fines or penalties incurred due to lack of permits or failure to comply with local regulations.

6. Alcohol Policy

  • Customers are welcome to bring their own alcohol (BYO) to their picnic events. However it is the customer's responsibility to research and ensure that alcohol is permitted at the chosen location and to comply with all local laws and regulations regarding alcohol consumption.

  • Sydney Picnic Moments is not liable for any fines or penalties incurred due to the consumption of alcohol at the event or any violations of local regulations.

  • Responsible Drinking: We encourage customers to drink responsibly and ensure the safety and well-being of all attendees at the event.

7. Liability

  • Customer Responsibility: Customers are responsible for their own safety and the safety of their guests during the event. Sydney Picnic Moments is not liable for any injuries or damages that occur during the event.

  • Damages: Customers are responsible for the proper care and usage of equipment during the event. The customer is liable for the replacement cost of any equipment that is stolen, goes missing, vandalised, or damaged during the event.

  • Clean Up: We are responsible for the standard clean up after the event. However, if anything is excessively dirtied or requires extensive cleaning beyond what is typical, we reserve the right to charge a cleaning fee.

8. Photography and Media Release

  • Sydney Picnic Moments may take photos or videos of the event set up for marketing purposes, including use on our website, social media, or other promotional materials.

  • If professional photos are included in your package, we may use the photos for social media and marketing purposes. Please let us know in advance if you do not wish your photos to be published.

9. Noise Level Policy

  • Customers and their guests must keep noise levels to an acceptable level throughout the event, respecting the comfort and peace of others nearby, including other guests, nearby events, and local residents.

  • Compliance with Local Regulations: Customers are responsible for adhering to local noise ordinances and regulations at the chosen location. Excessive noise may result in fines or penalties for which Sydney Picnic Moments is not liable.

10. Indemnification

  • Customers agree to indemnify, defend, and hold harmless Sydney Picnic Moments, its employees from and against any and all claims, losses, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or in connection with the customer's negligence, breach of these terms and conditions, or violation of any laws or regulations.

  • This includes, but is not limited to, any claims made by third parties for injuries or damages arising from the event that result from the customer's actions or omissions.

  • This obligation will survive the termination of these terms and conditions.

11. Privacy Policy

  • Customer recognises Sydney Picnic Moments collect and use personal information to facilitate the booking and service process.
